Under a new law that takes effect January 1, 2016, various changes will be made to Alabama's current noncompete law, including:

  • Six exceptions to the general rule that restraints on trade are void;
  • Presumptively reasonable time periods for some agreements;
  • Allowing a court to void a restraint in part and reform it to preserve the protectable interest; and
  • Remedies for the breach of an agreement.

In light of the development, the Alabama Terms of Employment and Employee Communications sections of the Employment Law Manual have been updated. In addition, a Legal Timetable entry has been added.
