California Amends Temporary Disability Insurance Law: Employment Law Manual Updated, Legal Timetable Entry Added

California has amended its temporary disability insurance (TDI) law. Currently, two consecutive periods of disability due to the same or a related cause or condition and separated by a period of not more than 14 days are considered as one disability benefit period. Effective July 1, 2016, the law will extend the time period to 60 days.

The TDI law requires a seven-day waiting period during which no disability benefits are payable. Also as of July 1, 2016, the waiting period will be waived for an employee who has already served the seven-day waiting period for an initial claim when he or she files a subsequent claim for the same or a related cause or condition within 60 days after the initial disability period.

In light of this development, the Insurance and Disability Benefits: California section of the Employment Law Manual has been updated and a Legal Timetable entry has been added.
