Conflicting Louisiana Same-Sex Marriage Decisions on Appeal: Employment Law Manual Updated

On September 3, a federal district court upheld Louisiana's statute and constitutional amendment banning same-sex marriage. The case is currently on appeal to the 5th Circuit Court of Appeals. On September 22, a Louisiana state court ruled that the state's laws banning same-sex marriage are unconstitutional. This ruling is subject to a stay of enforcement pending the state's appeal to the Louisiana Supreme Court.
In light of these developments, the following sections of the Employment Law Manual have been updated:

- Employee Leaves > FMLA: Louisiana; and
- Payroll > Taxation of Employee Benefits: Louisiana.
