Connecticut Employee Exercise of Constitutional Rights: Employment Law Manual Updated

Author: Marta Moakley, XpertHR Legal Editor

The Connecticut Supreme Court has clarified the circumstances under which an employer may discipline or discharge an employee based on that employee's exercise of First Amendment rights. In Trusz v. UBS Realty Investors, LLC, the Court interpreted state constitutional protections in light of the US Supreme Court's case Garcetti v. Ceballos, which addressed speech that was related to an employee's official job duties.

As a result, the Employee Discipline: Connecticut section of the Employment Law Manual has been updated.
