Delaware Discussion of Wages: Handbook Statement Added

Effective June 30, 2016, Delaware employers may not prohibit employees from disclosing, discussing or inquiring about their own wages or those of another employee. In addition, Delaware employers are prohibited from:

  • Requiring as a condition of employment that an employee refrain from inquiring about, discussing, or disclosing his or her wages or the wages of another employee;
  • Requiring an employee to sign a waiver or other document that denies an employee the right to disclose or discuss his or her wages; or
  • Taking adverse action against an employee who inquires about, discusses or discloses his or her own wages or the wages of another employee.

As a result of this development, the Discussion of Wages Handbook Statement: Delaware has been added to the employee handbook and the Delaware table of contents has been updated.
