Delaware Requirements Complete

XpertHR is on track to have all 50 states and the District of Columbia by the end of July. We are completing states on a rolling basis until then and are now up to 27 "states" with the completion of Delaware this week.

  • All Delaware employers are required to report newly hired and rehired employees to the state Division of Child Support Enforcement (DCSE) within 20 days of the date of hire or rehire. Employers that choose to report by electronic or magnetic means must report twice a month, not less than 12 days nor more than 16 days apart.
  • Though Delaware courts recognize the possibility that written provisions in employee handbooks or policy manuals may alter the at-will status of employees, in practice, the courts find very few such written provisions actually create implied contracts.
  • Employers may run maintenance or protection processes that manage the type or volume of email, telephone voicemail or Internet usage of employees, so long as the processes do not monitor or intercept the email, telephone voicemail or Internet usage of a particular employee.
