DOL Announces Grace Period for FLSA Domestic Service Exemptions: Employment Law Manual, Legal Timetable Updated

The US Department of Labor (DOL) on October 7 announced a grace period for new regulations governing the minimum wage and overtime exemptions for domestic service employees that take effect next year.

From January 1, 2015, to June 30, 2015, the DOL will not bring enforcement actions against employers that fail to comply with new regulations. During the next six months, from July 1, 2015, to December 31, 2015, the DOL "will exercise its discretion in determining whether to bring enforcement actions, giving strong consideration to the extent to which states and other entities have made good faith efforts to bring their home care programs into FLSA compliance."

The Employee Classification > Other Exempt Employees section of the Employment Law Manual and an entry in the Legal Timetable have been updated to reflect this development.
