DOL Issues New Guidance on Joint Employment: Employment Law Manual Updated

The US Department of Labor (DOL) recently issued new guidance about joint employment under the Fair Labor Standards Act (FLSA), the Family and Medical Leave Act (FMLA) and the Migrant and Seasonal Agricultural Worker Protection Act (MSPA).

The guidance aims to clarify the DOL's interpretation of when an employee is employed by two (or more) employers such that the employers are responsible, both individually and jointly, for compliance with the FLSA, FMLA and MSPA.
