DOL Proposes Extending FMLA Rights to All Same-Sex Spouses: Employment Law Manual Updated

On June 23, the US Department of Labor published a proposed rule updating the definition of spouse for purposes of the Family and Medical Leave Act (FMLA). If finalized, the new rule would extend FMLA rights to all legally married same-sex couples, even if they live in a state that does not recognize same-sex marriage. The FMLA section of the Employment Law Manual has been updated to include this new development.
