E-Verify Employee Notification: Immigration Content Updated

The US Citizenship and Immigration Services (USCIS) recently released an updated tentative nonconfirmation (TNC) further action notice, which employers must provide to employees in the event that their employment eligibility information does not match the records of the Department of Homeland Security (DHS).

The notice informs employees about the reason for the TNC and directs them to a new fact sheet with detailed instructions on how they can correct their immigration records. Employers should share the fact sheet with employees who receive a TNC result.

The federal Immigration, Form I-9 and Work Visas section of the Employment Law Manual and the Dos and Don'ts When Using E-Verify Quick Reference chart have been updated with information about the new notice and fact sheet.

An employer that uses E-Verify should review these developments and update its E-Verify policies and procedures accordingly.
