Author: Melissa Gonzalez Boyce, XpertHR Legal Editor

Effective March 2, 2016, an employer in Elizabeth, New Jersey, with 10 or more employees will be required to provide up to 40 hours of paid sick time per year. An employer with fewer than 10 employees need only provide up to 24 hours of paid sick time a year. Childcare, home health care and food service workers are eligible to receive up to 40 hours of paid sick time per year, regardless of the employer's size. In order to be eligible for sick time, an employee must work at least 80 hours a year in Elizabeth. An eligible employee will be able to take sick time for the following reasons:

  • The employee's or a family member's illness;
  • Closure of the employee's workplace or a child's school or day care due to a public health emergency; and
  • To care for a family member whose presence in the community would jeopardize others' health because of his or her exposure to a communicable disease.

As a result of this legal development, XpertHR has added the Paid Sick Time Handbook Statement [1-9 Employees: Elizabeth, New Jersey and the Paid Sick Time Handbook Statement [10+ Employees; Employers of Childcare, Home Health Care or Food Service Workers]: Elizabeth, New Jersey.
