Emeryville, California, Passes Minimum Wage, Paid Sick Leave Ordinance: Employment Law Manual, Charts Updated

The City of Emeryville, California, has passed a minimum wage and paid sick leave ordinance that takes effect July 1, 2015. The minimum wage provisions apply to employers that employ any person who works at least two hours in a calendar week in Emeryville and to each hour worked within city limits. The minimum wage will begin at $12.25 for employers with 55 or fewer employees and $14.44 for employers with 56 or more employees.

The paid sick leave provisions apply to any employer with employees working within the Emeryville boundaries and to employees who work at least two hours in a calendar week in Emeryville. Employees working for a small employer (55 or fewer employees) will be entitled to up to 48 hours of paid sick leave per year. Employees working for a large employer (56 or more employees) will be entitled to up to 72 hours per year. Employers are prohibited from retaliating against employees for filing a complaint or participating in any proceedings under the ordinance.

The ordinance contains employer notice and posting requirements to advise both current employees and new hires of their rights.
