As employers continue to struggle with the issue of determining full-time employee status for Affordable Care Act (ACA) purposes, XpertHR has added four new FAQs to the Health Care Reform Resource Center:
- Under the Affordable Care Act (ACA), are hours worked by volunteer firefighters counted when determining full-time employee status?
- Under the Affordable Care Act (ACA), are hours worked by a student in a work-study program counted when determining full-time employee status?
- What is considered a special unpaid leave under the Affordable Care Act (ACA)?
- Under the Affordable Care Act, how are hours of service measured for an employee who is out on a special unpaid leave?
Correctly categorizing employees is necessary for determining whether an employer is required to offer health benefits to full-time employees or else pay a penalty, and for determining to whom health benefits must be offered.
The FAQs have also been added to the following resources:
- Determine Applicable Large Employer Status Under the Affordable Care Act, Determine Full-Time Employee Status for 'Pay or Play' Purposes and Calculate Penalties Under the Affordable Care Act, found in the Tasks Tool; and
- Determine if a Penalty Is Owed Under the Affordable Care Act, located in the Liveflo Tool.
