Final Oregon Paid Sick Leave Regulations Released: Employment Law Manual, Quick Reference Charts Updated

The Oregon Bureau of Labor Industries (BOLI) released final regulations implementing the state paid sick leave law that goes into effect January 1, 2016. The regulations clarify issues related to:

  • Joint employment liability;
  • Determining hours worked for accrual purposes;
  • Calculating the total number of employees for determining whether sick time must be paid or unpaid;
  • Minimum increments of sick time use;
  • Determining the regular rate of pay for paid sick time;
  • Frequency of sick leave payments;
  • Frontloading;
  • Sick leave certification requirements; and
  • Employer notification requirements.

Accordingly, the following Oregon sections of the Employment Law Manual have been updated:

BOLI also released a new Oregon Sick Time Notification Poster, which has been added to XpertHR. An employer may use the poster to fulfill its notification obligations.
