While labor unions are not as commonplace in the financial services industry as in others, financial services employers must nevertheless be aware of the rights provided to employees under the National Labor Relations Act (NLRA). For instance, employers must be familiar with ways to prevent union organizers from gaining support by restricting distribution of union literature and solicitation of employees. Importantly, employers should also be aware of what constitutes protected activity among their employees, especially when it relates to social media and discussions between employees about terms and conditions of their employment.
