Form I-9 Self Audits, New Visa Regulations and Upcoming Supreme Court Decision: Employment Law Manual Updated

The Immigration, Form I-9 and Work Visas section of the Employment Law Manual has been updated to include the following developments:

  • Joint guidance issued by the Department of Homeland Security (DHS) and US Immigration and Customs Enforcement for employers on conducting internal Form I-9 audits;
  • DHS's revised regulations affecting highly skilled workers, particularly employees on E-3 and EB-1 visas;
  • New rules proposed by DHS that would extend the science, technology, engineering or mathematics (STEM) optional practical training (OPT) program and increased compliance requirements for participating employers; and
  • The Supreme Court determination that it will rule whether the Obama administration can allow undocumented workers to request work permits and deportation relief for three years at a time if they have been in the US for at least five years and have children who are citizens or legal residents, among other requirements.
