Illinois Adds Overtime Exemption for Unionized Employees on Alternate Schedules: Employment Law Manual Updated, Legal Timetable Entry Added

Author: Michael Cardman, XpertHR Legal Editor

Illinois has passed a law establishing a new exemption from its overtime law.

Effective January 1, 2016, members of a bargaining unit recognized by the Illinois Labor Relations Board whose union has contractually agreed to a 1040/2080 alternate shift schedule, as allowed by the federal Fair Labor Standards Act, will be exempt from the state's overtime requirements.

As a result of this development, XpertHR has updated the Employee Classification: Illinois section of the Employment Law Manual and added an entry to the Legal Timetable.
