Authors: Melissa Burdorf and Beth Zoller, XpertHR Legal Editors

Illinois has issued final regulations on pregnancy discrimination and accommodation in employment. Although the regulations were issued November 20, the effective date is November 4.

The final regulations differ slightly from the proposed regulations issued in July. Modified provisions include:

  • The definition of common condition related to pregnancy or childbirth;
  • Alternate accommodations; and
  • Time off or leave as an accommodation.

In light of this development, the EEO - Discrimination: Illinois and Disabilities (ADA): Illinois sections of the Employment Law Manual have been updated and a Legal Timetable entry has been added.
