Massachusetts Clarifies Paid Sick Leave Safe Harbor Provision: Employment Law Manual Updated

On June 10, the Massachusetts Attorney General (AG) provided clarifying details on the state's paid sick leave law safe harbor provision that was announced last month. The safe harbor provision applies to employers that have a paid time off policy in place as of May 1. The paid sick leave law takes effect July 1.

The AG has clarified requirements related to:

  • Employees not previously covered by the policy;
  • Lump sum allocations of paid time off; and
  • Employees earning 30 or fewer hours of paid time off.

In light of this development, the Massachusetts Other Leaves: Massachusetts and FMLA: Massachusetts sections of the Employment Law Manual have been updated.
