The Michigan Court of Appeals has held that employees who are terminated for testing positive for marijuana may not be disqualified from receiving unemployment benefits if they are registered users of medical marijuana under the Michigan Medical Marihuana Act.
In light of this development, the following Michigan sections of the Employment Law Manual have been updated:
- Organizational Exit > Involuntary Terminations;
- Employee Benefits > Legally Required Benefits; and
- Employee Management > Employee Discipline.
