Montana Amends Military Leave Law: Employment Law Manual Updated

The Montana Military Service Employment Rights Act has been amended to replace state active duty with state military duty throughout. The law's provision limiting covered duty to that performed by a National Guard member during a state-declared disaster or emergency has been removed. State military duty includes state duty for special work, which is defined as any activity, such as administrative functions, exercises, training, coordination or planning, conducted for the purposes of preparing the Montana National Guard for active duty.

In light of this development, the Montana USERRA section of the Employment Law Manual has been updated.
