Nevada Supreme Court Eliminates Minimum Wage Exemptions: Employment Law Manual Updated

Nevada highest court recently issued a ruling that effectively eliminates certain exemptions from the state's minimum wage law.

Under Nev. Rev. Stat. § 608.250, minimum wage exemptions had been available for:

  • Casual babysitters;
  • Domestic service employees residing in the household where they work;
  • Outside salespersons whose earnings were based on commissions;
  • Taxicab and limousine drivers;
  • Certain agricultural employees; and
  • Certain workers with disabilities.

This statute remains on the books. However, the Nevada Supreme Court ruled in Thomas v. Nev. Yellow Cab Corp., 130 Nev. Adv. Rep. 52 (Nev. 2014) that a 2006 constitutional amendment "supersedes and supplants" the statute.

The Employee Classification: Nevada section of the Employment Law Manual has been updated to reflect this ruling.
