New Jersey Ban the Box Law Applies to Private Employers: Employment Law Manual Updated
Author: David B. Weisenfeld, XpertHR Legal Editor
Effective March 1, 2015, New Jersey has become the sixth state with a "ban the box" law that applies to most private employers. The Opportunity to Compete Act prohibits employers with 15 or more employees as well as employment agencies from making any inquiry about a job applicant's criminal record during the initial employment application process.
In light of this new development, the following New Jersey sections of the Employment Law Manual have been updated:
- Interviewing and Selecting Job Candidates;
- Negligent Hiring;
- Preemployment Screening and Testing; and
- Employment Offer.
The Ban the Box Laws by State and Municipality Quick Reference Chart has also been updated.
