New NLRB Forms Released: Employment Law Manual Updated, Forms Added
Author: Melissa Gonzalez Boyce, XpertHR Legal Editor
As a result of the new union representation case rules and procedures effective April 14, 2015, the National Labor Relations Board (NLRB) has released new forms for employers, unions and employees. One of the major changes reflected by the new forms is the fact that the NLRB now provides separate petition forms for the various NLRB procedures (e.g., union certification/election, amendment of a certification, decertification) whereas, before April 14, there was one general petition. In addition, the NLRB now provides forms required to be served upon the parties that describe the relevant procedure and rights and responsibilities of all parties named in the petition.
Accordingly, the following forms have been added to the Policies and Documents tool:
- Form NLRB-502 (AC) - AC Petition
- Form NLRB-502 (RC) - RC Petition
- Form NLRB-502 (RD) - RD Petition
- Form NLRB-502 (RM) - RM Petition
- Form NLRB-502 (UC) - UC Petition
- Form NLRB-502 (UD) - UD Petition
- Form NLRB-505 - Statement of Position
- Form NLRB-4812 - Description of Representation Case Procedures in Certification and Decertification Cases
- Form NLRB-5081 - Questionnaire on Commerce Information
- Form NLRB-5544 - Certificate of Service of Petition
- Form NLRB-5545 - Certificate of Service of Voter List
- Form NLRB-5546 - Request to Block Petition
- Form NLRB-5547 - Description of Election and Post-Election Representation Case Procedures
In addition, the Union Organization and Labor Relations section of the Employment Law Manual has been updated.
