New York City Revises Paid Sick Leave FAQs, Proposes Clarifying Rules: Various Documents Updated

The New York City Department of Consumer Affairs (DCA) recently revised its paid sick leave FAQs webpage, clarifying several areas of the City's Earned Sick Time Act (ESTA), including:

  • Employer coverage;
  • Employee coverage;
  • Eligible reasons for using sick time;
  • Carryover and frontloading of sick time;
  • Rehired employees;
  • Employer posting and notice requirements; and
  • Retaliation.

Separately, the DCA also proposed amendments to the ESTA rules. A hearing on the amendments was held on January 11. The rules need to be finalized and published before taking effect.

In light of these developments, the following New York sections of the Employment Law Manual have been updated:
