The New York State Department of Labor has extended for three years the 2012 amendments to the permissible wage deductions that were set to expire on November 6, 2015. The amendments will remain in effect until November 6, 2018.

In addition to deductions already permitted by law, the amendments allow an employer to make deductions from employees' wages for items such as wage overpayments, loan repayments, and the cost of gym memberships, parking or mass transit passes and daycare, subject to certain restrictions.

In light of this development, the Payment of Wages: New York and Minimum Wage: New York sections of the Employment Law Manual have been updated along with the relevant Legal Timetable entry. Also updated is the Quick Reference chart Permitted and Prohibited Pay Deductions by State.
