On October 6, the US Supreme Court declined to review challenges to three federal appeals court rulings striking down same-sex marriage bans in Indiana, Oklahoma, Utah, Virginia and Wisconsin, thereby allowing same-sex marriage in those states. The Supreme Court's refusal to review the cases cleared the way for the legalization of same-sex marriage in other states that fall under the jurisdiction of the appeals courts, including Colorado, North Carolina, West Virginia and Wyoming.
Shortly after, other courts struck down same-sex marriage bans in Alaska, Arizona, Idaho and Nevada.
In light of these developments, the following sections of the Employment Law Manual have been updated:
- Alaska - FMLA and Health Care Benefits;
- Arizona - FMLA, Health Care Benefits and Taxation of Employee Benefits;
- Colorado - FMLA, Health Care Benefits and Taxation of Employee Benefits;
- Idaho - FMLA, Health Care Benefits and Taxation of Employee Benefits;
- Indiana - FMLA, Health Care Benefits and Taxation of Employee Benefits;
