Same-Sex Marriage Rulings in Utah, Wisconsin: Employment Law Manual Updated

The legalization of same-sex marriage continues to progress through the states, as the issue makes its way through a maze of rulings, stays and appeals.

In early June, a federal district court in Wisconsin held that the state's ban on same-sex marriage was unconstitutional; however, the ruling will not be enforced until the matter is settled by the 7th Circuit Court of Appeals (or, possibly, the US Supreme Court).

In late June, the 10th Circuit Court of Appeals affirmed a December 2013 federal district court ruling declaring Utah's same-sex marriage ban unconstitutional. The district court ruling had been stayed pending the 10th Circuit appeal. Now the stay remains in effect pending appeal to the Supreme Court.
