Same-Sex Marriage Legalized

On June 26, 2015, the Supreme Court ruled in Obergefell v. Hodges that the Constitution requires all 50 states and the District of Columbia to license same-sex marriages and to recognize such marriages that are lawfully licensed and performed out of state. This historic ruling clears the way for same-sex marriages nationwide by declaring that same-sex married couples can no longer be denied the benefits that are provided to opposite-sex married couples.

This case marks the Supreme Court's second landmark ruling on same-sex marriage in two years. In 2013, in United States v. Windsor, the Court struck down as unconstitutional Section 3 of the Defense of Marriage Act (which defined marriage as only between one man and one woman and limited the term spouse to an individual of the opposite sex). As a result of the Court's ruling, married same-sex couples residing in states where same-sex marriage was legal became eligible for the same benefits and protections as opposite-sex spouses, such as protection under the Consolidated Omnibus Budget Reconciliation Act, the Family and Medical Leave Act, the Employee Retirement Income Security Act, immigration law and Social Security. The decision did not, however, address the right of states to recognize or deny same-sex marriages.
