San Francisco: New Law Restricts Criminal History Inquiries

A new San Francisco ordinance will require private employers with 20 or more employees to remove criminal history inquiries from job applications. The law, knows as the Fair Chance Ordinance, also prohibits employers from asking about or obtaining the conviction history of job applicants until after their first live interview.
The following California sections of the Employment Law Manual have been updated to reflect this new development:
- Recruiting and Hiring > Preemployment Screening and Testing;
- Recruiting and Hiring > Negligent Hiring: and
- Employee Management > Employee Privacy.
