South Dakota Same-Sex Marriage Ruling Stayed Pending Appeal: Employment Law Manual Updated

On January 12, a federal district court in South Dakota ruled that the state's law banning same-sex marriage is unconstitutional. The decision was immediately stayed pending appeal. Therefore, same-sex marriage remains prohibited in South Dakota.

In light of this development, the South Dakota FMLA and Health Care Benefits sections of the Employment Law Manual have been updated.
