The National Labor Relations Act protects the rights of an employee to organize and form a union in order to address issues regarding wages, hours and working conditions without fear of discipline or termination. However, an employer has the right to express its position to its employees during the union campaign. Before doing so, it is critical that an employer understand the rules created by the National Labor Relations Board that set forth what it may and may not say or do during the time leading up to a union representation election.
