Author: Allen S. Kinzer, Vorys, Sater, Seymour and Pease LLP

Summary

  • Kentucky law regarding hours worked is, for the most part, consistent with the Fair Labor Standards Act (FLSA). Accordingly, employers should consult the federal standards when calculating the hours worked by employees.
  • However, Kentucky law imposes meal and rest break requirements not found in federal law. See Break Periods.
  • Time spent in certain apprenticeships may be excluded from working time. See Apprenticeships.
  • Kentucky also has a day of rest law. See Day of Rest.
