Summary

  • Labor relations for private sector employees fall primarily under the National Labor Relations Act (NLRA). Where the NLRA does not have jurisdiction, state law may apply. In Delaware, some occupations are specifically exempted from the state labor relations law. See State Labor Relations Law.
  • Employees have rights similar to those under the NLRA; that is, they have the right to strike and to engage in other lawful concerted activities. See Rights of Employees.
