  • An employer may be held liable for the wrongful acts of its employees that are committed during the course and scope of employment. See Liability for Employee's Conduct.
  • Kentucky recognizes negligent hiring claims, which provides for employer liability even if the wrongful acts committed by the employee were outside the scope of employment. See Negligent Hiring.
  • In order to help minimize liability for negligent hiring claims, employers should carefully consider the nature of the job for which a person is being hired and make sure that an appropriate background check on each applicant is performed before hiring.
