- In addition to the protected categories under federal law, Kentucky employers cannot discriminate against smokers. See Discrimination Prohibited.
- In Kentucky employees are presumed to be at-will employees unless the employer's workforce is subject to a collective bargaining agreement and the employee is a member of that bargaining unit or employees have individual contracts of employment. See At-Will Employment.
