Summary

  • In addition to federal antidiscrimination laws, Nebraska maintains its own antidiscrimination laws prohibiting discrimination on the basis of race, color, religion, sex, disability, marital status and national origin. See Employment Terms Must Comply With Nebraska Antidiscrimination Laws.
  • Nebraska courts have established criteria for making determinations regarding whether a person should be classified as an employee or independent contractor. See Determination of Whether an Employer-Employee Relationship Exists.
  • Nebraska follows the general rule that in the absence of a contract, express or implied, between an employer and an employee covering the duration of employment, the employment is terminable at the will of either party, and the employee has no cause of action for breach of contract upon discharge from employment.
