- The West Virginia Labor-Management Relations Act (LMRA) prohibits employers and labor unions from engaging in numerous unlawful actions, known as unfair labor practices. See Unfair Labor Practices under the Labor-Management Relations Act.
- Generally, an employer cannot interfere with an employee's right to organize and bargain collectively and a labor organization cannot force an employer to join an employer organization or give certain work to member-employees or force non-employees to join the labor organization. See Unfair Labor Practices for Employers; Unfair Labor Practices for Labor Organizations.
- The authority to prevent and remedy unfair labor practices is vested solely in the West Virginia Labor-Management Relations Board. See Prevention and Remedies.
