  • Montana employees need not provide advance notice of resignation unless they have a specific contract which so requires. See Notice of Resignation
  • Noncompete agreements are generally not enforceable against resigning employees unless they are reasonable in time and geographic scope. See Noncompete Agreements.
  • Employers should take precautions to ensure that resigning employees are not doing so under circumstances that could lead to constructive discharge claims. See Constructive Discharge.
