Yes. Covered entities are required to comply with HIPAA's Privacy and Security Rules, and health plans are considered covered entities under HIPAA. For these purposes, health plans include health insurance issuers; HMOs; company provided health plans; and government programs, such as Medicare, Medicaid and military and veteran's health care programs. Health plans are required to protect the privacy and security of health information and are required to provide individuals with rights with respect to their health information.
