Does an employer have the right to search an employee's personal vehicle?

Yes. If an employee's vehicle is on the employer's premises and the employer has a policy stating that any vehicles on the employer's property are subject to search, then the employer will most likely have the right to search the vehicle. However, an employer should not try to pry open a locked car or try to gain entry without permission. It is important to note that certain states provide employees with greater privacy rights than federal law. Further, it is critical that employers have a legitimate business-related reason for conducting the search and that all searches are based upon reasonable suspicion.
