Is a pregnant employee or applicant entitled to special treatment?

Author: Beth P. Zoller, XpertHR Legal Editor

Under the Pregnancy Discrimination Act, as well as similar state and local laws, an employer may not treat employees with pregnancy-related conditions differently than other individuals who are similar in their ability or inability to work. Pregnancy and non-pregnancy conditions should be treated to the same processes and procedures and pregnant employees should not be singled out for special treatment.
