While family responsibility discrimination is not specifically protected under federal law, an employee or applicant may bring a claim against an employer for family responsibility discrimination under Title VII, which prohibits discrimination based on sex; the Americans with Disabilities Act, which prohibits discrimination based on disability; and the Family and Medical Leave Act. Additionally, other state and local antidiscrimination laws may specifically prohibit family responsibility discrimination or prohibit discrimination based on familial or marital status.
