May an employee change his or her flexible spending account (FSA) elections midyear?

No. Generally speaking, an employee who has completed his or her FSA election is required to maintain that level for the entire plan year. There are a limited number of exceptions to this rule, with some changes to elections being permissible based on changes in employment status, such as an employee taking Family and Medical Leave Act (FMLA) leave or if a participant's spouse loses or gains a job, and changes in family status, including a change in the number of dependents due to birth, adoption or death or a change in marital status.
