May an employer discipline an employee with a gambling problem?

Yes. An employer may discipline an employee with a gambling problem if the employee violates a workplace rule related to gambling on the premises, personal phone calls or use of the internet, attendance issues, etc. An employer may discipline an employee for violations of work rules even if the underlying cause is a gambling addiction. Further, an employer should be aware of any state or municipal laws or laws governing federal agencies that address illegal gambling and gambling in the workplace. If an employee engages in illegal gambling in violation of a relevant law or statute, the employee may be subject to discipline.
