Employee Rights to Access Personnel Records by State

Whether an employee has a right to inspect or copy his or her personnel records is a state-driven issue that depends on several factors, including whether the employer is a public or private employer. In most states, however, employees enjoy a limited right to inspect specific personnel records. Certain states provide employees with the opportunity to include a written statement disputing any information contained in the personnel file that the employee deems to be inaccurate. Also, some states require employers to take steps to notify employees if negative information is placed in their files.
