How to Lawfully and Legally Search Employees

Whether employing a single employee or many, employers may experience violations of employer policy or other acts of dishonesty that require employees to be searched. In order to ensure that a search is legal, the employer must weigh the business and security interests of the employer against the privacy rights of employees. While employee searches can be lawful in most instances, it is important to approach employee searches in a measured, reasonable manner. Failure to do so can result in a legal claim against the employer.
