Tennessee amended its Employment Security Law regarding seasonal employment, effective July 1, 2016. However, the amendments apply beginning July 1, 2020.
Beginning in 2020, an employer must apply for seasonal employer status with the Department of Labor and Workforce Development (Department) every year between September 1 and October 31.
A seasonal employer must also fulfill the following employee notice requirements:
- Post a notice of the Department's seasonal determination;
- Provide written notice to each seasonal worker that seasonal wages are potentially excludable from the base period; and
- Provide written notice to a seasonal worker of a change in seasonal worker status.
