Employers Can Now Apply Online to Employ Workers With Disabilities at Subminimum Wages

Employers can now apply online for permission to employ workers with disabilities at subminimum wages instead of mailing in a paper application.

The US Department of Labor's Wage and Hour Division (WHD) has launched an online tool that allows employers to submit their applications electronically for a special certificate to employ workers with disabilities at subminimum wages. The online tool guides applicants through the information needed to complete their applications, submits the applications directly to the WHD and provides users with PDF copies of their submissions.

The WHD said the tool will help ensure that applicants submit complete applications and increase the speed and security of their submissions. Both new applicants and those renewing existing certificates may use the online portal.

Employers that prefer the old-fashioned way - submitting paper applications by mail - may continue to do so using WHD's Form WH-226 (accompanied by a separate Form WH-226A for every establishment or work site for which they seek approval to employ workers with disabilities at subminimum wages).
