New Pay Deductions Soon to Be Available in Kansas

Under a new Kansas law effective July 1, 2013 (+2013 Kan. HB 2022), if an employer and employee agree in writing, an employer will be permitted to make the following new types of deductions from employees' pay in addition to the few that are currently allowed:

  1. To repay a loan or advance;
  2. To recover a payroll overpayment; and
  3. To compensate the employer for the replacement cost, or unpaid balance of the cost, of the employer's merchandise or uniforms purchased by the employee.

Employers will also be permitted to make deductions from an employee's final wages to recover certain types of property provided to the employee in the course of business, if certain requirements are met.
